A Section 8 Notice is used in situations where your tenant is behind in their rent payment by at least 2 months. Once you serve the section 8 notice your tenant has up to 14 days to pay or leave your property. If Your tenant dos not pay you can ask the courts for a possession order and a money order but your tenant has a right to a court appearance which takes six to eight weeks.

A successful section 8 eviction notice will give the landlord the right to his property and to the rent in arrears. The process begins when the landlord, or his issue, serves the section 8 notice to the tenant. Upon notice the tenant has 14 days to pay the back rent or vacate the premises.

If the 14 days pass and nothing has been done the landlord will proceed to the courts. The section 8 notice eviction notice can be used for short term tenants and assured tenants who are in arrears. In some cases a landlord will issue both notices at the same time. section 8 and section 21 .

The section 8 notice is used by a landlord to encourage his tenants to pay rent owed before the situation becomes untenable. It is the hope of the landlord that the notice will provide enough impetus for the tenant to pay the back rent, continue to pay on time, and continue to live on the premises.

Where rent arrears exist if successful, you get both a possession order to get your property back and a money order for outstanding rent. If you fall foul of a section 8 possession order even by making one minor date error, the financial repercussions can be devastating. Whilst you are fighting to rectify the situation, tenants are sitting tight, many not paying rent. By the time the court sorts things out it is often 6 or 7 months later and the landlord has suffered losses that may well break them. If everything goes smoothly the process can still take three or four months. Making a mistake generally adds another three months. The rent goes unpaid and the landlord will never see that money.
